paystubs question

Hi all,

I plan to go to chennai for stamping (F1 to H1) in Nov 04. While i was on OPT, i received pay without having to pay Social Security and Medicare taxes (On F1, its not necessary to pay these). However, after my H1 was approved, my employer continued to pay me without deducting the Medicare and SS taxes.

I changed my employers and now receive the "proper" paystubs. I have 4 months worth of paystubs that are actually correct (with all deductions). When i go for stamping, is it okay to submit these or will I be asked for all the paystubs in the current year ??

I don't agree with some of Ginnu's answers.

Sure, they can ask for any and all documents, but they typically only look at the last 2-4 paystubs, if at all.

Secondly, as an individual, you can claim any exemptions you feel you're eligible for on your W4 or otherwise. I'm sure the CIS/DOS guy looking at your documents is not a tax expert, and he is likely not looking at your individual tax amounts deducted - he is probably only looking at your taxables - which is an indication of your wage (this period and year-to-date amounts).

You should be fine...

You cannot claim exemptions on SS/Medicare taxes :)

If you know of a way to do that, let me know and I'll pay you a cut :D

Check out IRS publication 15A, pages 7, 8, 11, 15 for starters.

Is it for everybody? No - but the point is, it's possible and I'm sure CIS/DOS officials do not know enough about tax law and IRS regulations to determine eligibility for exemptions.
