Pay Stubs Problem

Hi

I am in the USA on H1 visa since June 2008. My employer has been unable to find me any projects and has not paid me until now which means that I do not have any pay stub. I have now received an offer from an Indian company in the USA that is willing to do an H1 transfer for me and absorb me as their employee.

Under these circumstances how do I approach my employer for pay stubs?
What is the general reaction of employer? Do my employer give the pay stub or create problems?

Ask the employer to pay you. Send email/fax and keep the reply. Employer is supposed to pay you on H1. if he still don’t pay you can file complaint with DOL and DOL will recover your wages from employer and employer may be finded and may not be able to file H1 in furure. Employer cant keep you on BENCH or Table employer need to pay you.
What is the general reaction of employer?
