Passport validation and H visa

My H4 is going to expire by the end of Feb. I am going to Canada for revalidation of my H4 visa which is approved for 3 years. The problem i am facing is that my passport expires in 2008 August. I cannot renew my Indian passport before 1year of the passport expiry date. Now the situation is that according to the US visa rules my passport should be valid for six months after my intended stay in US. I cannot renew my passport now, and my visa is for 3 years...which basically means i need to have a passport valid for about 3.5 years. I dont know what to do. Please reply immediately if you went through a similar situation.

Your passport is valid till 2008. US consulate will stamp the visa till H4 approval notice if it is for 3 years then they will stamp for 3 years and once you get your new passport keep both the passport stapled. Once you enter US from Canada after visa stamp your I-94 may be valid only till passport expiry date 2008 August not till your visa stamp expiry date (if officer is new he may give you I-94 till Visa stamp). Talk to your lawyer for more info.

**** FYI if you request to Indian consulate they don’t have problem to give you new passport (they give new passport any time if the passport is damaged). When you visit Indian consulate explain to them that have problem for visa stamping and I-94 validity when enter. Go directly to DEPUTY CONSUL GENERAL or CONSUL (HEAD OF CHANCERY/PASSPORT & VISA) and explain the problem

passport issues.

I was so much worried as my passport was about to expire in 1 and 1/2 year and my visa was for 3 years. But at the consulate they never asked a question about it. As long as passport is valid for at least 6 months from the visa date its fine. I got full term visa and there was no problem with immigration too. They gave me the I-94 with full 3 years validity.
