Hello,

This is a sort of a general question that came up during a discussion in my office:

If an immigrant is working in the USA on a an employer sponsored TN-1 and engaged in a part-time work (without a second work permit) for which s/he was issued a 1099, how does USCIS find out that such activity has taken place? Is USCIS notified when s/he files taxes or if reports are made to social security?

Thanks - LM

Sometimes.

At this point being that it's USDHS (Department of Homeland Security) that is the Immigration authority and I'd assume they have or can get copies of EVERY document you have ever signed while in the US.
Just make certain you never carry anything outside of or back into the US that identifies a 2nd workplace, ever..
Whoever the question was about should just stop the part-time work and be happy they got away with it.
