I have to travel to Guatemala on Sunday and I have sent off my application for travel, I-131. Can I wait over there and get my wife to forward the document to me when it arrives? How will the INS know I have left the country without it? thanks alot.
Well, when you leave the country, they collect your I-94, and I think they turn it in to BCIS. Now whether BCIS ever cross checks if you left before getting AP, I don't know......
They will not check for your AP before leaving the country. Assuming Gautemala is the country that you have the passport with, there is a possibility that your AP might not have been approved by the time you want to come back. Then you would have to stay for some more time. I don't know if there is any maximum time that you can stay out of the country.
Don't even think about travelling before getting the AP, you AP may never get approved once you are out of the country and will never be able to come back.

Your AP will still be processed even if you are not in this country. Your wife can collect it and send it to you. The only risk is if there is severe delay in getting the AP approval. I know some of my friends have gone to India (due to urgency) without a AP and their friends have collected their AP and sent the papers to India.
I am sorry, I didn't mean to scare any one, But the fact of the matter is once you are on AOS and if you are out of country you application ( I-485) will not be taken up for adjudication.
Also there is an inherent risk in travelling before getting the AP.
once your I-94 record are entered in to the system( I beleive they are doing it ) you may never get the AP.

As I do not require AP or a visa stamp to return to my home country, nor do I need to surrnder my I-94, I question the validity of this statement. Second, there's nothing in the I-485 processing manual (that was posted here some months ago) that indicates that this would happen.
What basis do you have for making such a statement?

I have been told by the INS my AP will be approved but not until next week. If I leave on Sunday it looks like the only safe way to do so would be to not suurender my I-94, as it has been "misplaced".
I am sick and tired of being held to ranson by the BCIS.
