My mother's I130 is approved and visa is being processed at National Visa Center (DS230). She also has 10 years visiting visa. Can she come and stay with us within usual allowed time, while her forms are being processed, until she gets notification (I am her Agent) to attend for visa at Indian embassy? Have any one did this before? Please share your experience, ideas or advises.

She can attempt to enter the US as a visitor but she may be denied entry. I visited the US during the time my K-1 visa was being processed, but my situation was slightly different. I had the advantage of holding a Canadian passport. I could have still been denied entry and I always had that in mind.

Need advice related to the same topic

Hi,

My father has a 10 year multiple entry visa to the U.S. I am sponsoring his GC, his I-130 was approved in September. We applied for AOS, paid the $400 fee. We got a enquiry that some documentation was missing. We are in the process of getting those together, but I wanted to bring him here in the meantime for a visit. Since we already applied for a consular processing will it be ok for him to travel on his temp. visa in the meantime? My mom passed away recently and I am desperate to have him here, so he can have a change of place.

I wanted to check if you brought your mom here on the vist visa or if there was any problem with that?

Thanks in advance.

Firstly, you did not pay $400 for AOS. You paid that for CP.
Secondly, your father may attempt to visit you while his immigrant visa is being processed. He should be mentally prepared for the possibility of being denied entry and being put back on the first flight back.
Lastly, my condolences on your mother's passing away. May she rest in peace.
