hello i need a little advise on what to do from here, i have been living in the states for over a year now trying to save money to pay to adjust my status as a permanent resident, unfortunately things have not gone to plan and we are running out of money,
my wife lost her job and now we have little income coming in she gave birth to our first daughter last February and now we have another baby on the way, the fact is that we will be out on the streets soon if we don't get some money soon

the thing is i can go back to canada and work but the problem being that i overstayed my visit, i entered with my passport, i am worried that if i leave i will be subject to being banned from the states for three years before i can come back and be with my wife and children, my wife does not want to leave the states being a u.s army vet and having a daughter from a previous relationship she does not want to uproot her daughter as it would be hard on her

is there any way i can leave without facing the 3 year ban or having troubles with customs, i don't know what kind of information they have available to them if i would be flagged in there system for overstaying my visit.

i am running out of options, no one is able to help us in the situation i have gone to churches and immigration groups and none of them are willing to do anything except offer a consultation which would cost money we don't have

there is not alot of work that a pregnant women can do around were we live only factory or restaraunt jobs that would require her to be on her feet all day and she cannot stand more than an hour without being in a lot of pain

i don't have the 2500 needed to pay for the visa and i don't think we would be able to last 7 months to a year either without us finding work

i don't want to be seperated from my family, miss the birth of our newest child and miss them growing up for so long, i don't know what else to do, it wouldn't be so bad if i knew i could come back but i am worried that i won't be allowed back in
 
Your wife and children (including hers from prior relationship) are all USC's and eligible for assistance. She can get unemployment if eligible, and the kids at least can get other aid.

On the immigration issue, lay low because you have already blown your chances for leaving without a bar to re-entry. Even if you could file for adjustment now, could she qualify as to income for the I-864? Not a chance on her own. Has she got someone that would be willing to help on that issue?

yes she does have someone that can file the i 864 but we just don't have anyone that can spare an extra $2000 for all the forms and other paperwork
 
I dont understand, what is the real question here? Forgive me and I know it's too late to bring this up but maybe you will think about it next time but why have another kid if you're having such financial troubles?
 
If you go back, you will be barred for ten years, since you're past 180 days. You just got to find a way to make it, for your wife and kids. Whatever it takes (legally). After the baby is here, than she can try to get a job.
