Options - applying for spouse's greencard

My application for CZ is pending. Interviewed but waiting for oath.
When it gets approved I would like to sponsor my fiance who is on a H (work) visa.
What are my best options?

Someone told me to apply for I-130 first so that I can upgrade the application as soon as I get my naturalization. They said it would save time. Is that true and how much time will we save? I realize we need to get married before I apply for I-130.

Second, because he is my fiance still (not married) are there other options that may help us speed getting him the GC (convert to K (fiance) visa, etc)?

Since your done from your interview and waiting for your oath, I would say just finish up with you CZ and then file I-130-1485 together. Its easy and I think best bet for you. But you will have to be married before that. I think fiance option is good if your she is not in the US.

- How long does the I-485 & I-130 process take? There is also the EAD that he become eligible for right? File that with I-485?
- Do you have any link where I can read about the process that one has to follow after CZ?
- Fiance has been on an H1 since coming to the country. Has a clean record. Never been out of status or had any run-ins with the law. Do we need to go thru attorney? Or is the process straightforward enough (like CZ) that we can do on our own?

Download forms I-130, I-485, G-325, I-131 and I-765 from the USCIS web site. They are fillable PDFs, but you might want to print them and do them by hand for the first draft. If you can fill them out, you do not need an attorney.

It depends on your DO. You can file I-765 for EAD with I485.

You can do it on your own. Remeber you guys need to be married.

my husband filed for me i-130 first, its got approved in 2 or 3 month. then we filed i485 and the rest -affidavit,,,we started process in february and in june i already had my gree card-in Newark ,NJ

On the contrary, there is a benefit to filing them together, because that way you save time.
 
Atlanta DO

We filed for GC in the Atlanta DO (probably through TSC) back in April '99.

It took 27 months for my wife to get her GC. (Around Aug 1, '01)

But, she got her Advanced Parole (travel doc) in 30 days, and her temporary work permit in 90 days (she had to go to Atlanta DO for this).

One thing to keep in mind: While your 485 is pending, you can get a temporary work permit - and can travel on an "advanced parole" document. You should file for these at the same time with the I130/485. If you are in a fast district and/or don't think he will have to travel (internationally) or work, it may not matter. All this is discussed in another section of the forum - to which you have, I believe, already been directed.
