OPT vs H1B - What can I use.

Hello Friends,

I am currently on OPT which is valid till July 2009. Also, my H1-B is approved through a company X starting oct 2008. I got a job with company Y on my OPT. Can I continue to work on my OPT with company Y till July 2009? OR Do I need to transfer my H1B to company Y to be able to continue to work after Oct 2008?

Can someone kindly respond to my query above. Does the H1-B come into affect only if it is used as a document in the W-9? In other words can I continue to work with company Y using my OPT.

Your status is supposed to be changed on Oct 1 08 and you'll be on H1, not F1(OPT) from that date.

Thanks for your prompt response. Now since I am working with company Y(on OPT) and my H1-B is with company X, Can I transfer my H1-B from Company X to company Y without any pay stubs from Company X? Also, what can be the start date on the offer letter from company X?

Maybe you can.
You can set start date to 10/1.

Also, is it possible to cancel / withdraw my H1-B with company X, so that I can continue to work with my OPT with company Y. (Checking this option as I am not sure if company Y will be willing to sponsor for my H1-B).
