opt period ended and applied for H1-B visa

Hi,

I need some suggestion and opinion. My OPT period ended on june 30th 2005. I have applied H1 B visa this week. Right now I'm on grace period which is provided after opt period. So my concern is would I be in legal status if I get approval or receipt of H1-B visa petition which was applied in advanced degree cap(20000 visa cap)? In the mean time I would consult lawyer, Please some great gurus are there who can post some opinions.

If you would have applied through Y 2005 US MS degree,you will be alright because start date is immediate. Like last year this year that provision of grace period bulletin not yet come so far.
