Hi,

Right now i am on OPT and it is expiring on Feburary 28th,2006. My H1 got approved in September 2005. I didn't get H1 Stamping. Is it a mandatory that we should get H1 stamped before OPT expires or can we stamped at any time.what will be my status from March 1st.

Please clarify on this.

It depends on if you got I94 with approval notice. Check your approval notice and let us know.

Thanks for the reply, I checked my approval notice and petiton, and it has the I-94 Form. So now what is my position, do i need to go before my OPT expires or can i go at any time i want?

That mean you can go back anytime and get it stamped. I-94 is basically given to people when their change of status is approved ....CHEERS !

It means change of status was filed and approved.
There should be start date on approval notice. You'll be on F(OPT) til H1 start date on approval notice(assuming H1 start date is before OPT expiration), and will be on H1 after H1 start date. Since you got I94, you do not need to travel to get stamp, however, if you travel after H1 start date, you have to have H1 stamp to reenter.

My wife's OPT expired in August 2004. She got her H1 approval notice with I94 with a start date of Oct.2004. I believe since the gap was only 60 days, she would be allowed to stay but NOT work till Oct.1, 2004. Can you please confirm if this is true?

Yes, she has 60days grace period after OPT expires and if the grace period covers til H1 start date, she can stay and start working upon H1 start date. As you mentioned, she can not work between OPT expiration and H1 start date.
