Hi all: :)
I am recently experiencing the pangs of Immigration and am pretty shaken up..
I came to US on F 1 status and completed a Master's program. When I was trying to apply for OPT I was told I would be ineligible as I had taken a break of more than 5 months in between(had to go back to my home country as my mother was sick.....in my last semester) I thought I could come back finish my last semester and get my OPT...But my DSO told me that is not possible and asked me to take more classes. I didnt want to take more clases and did apply for OPT....
Consequence: Got a RFE for more information like Diploma etc..
Meanwhile I did apply for H 1 B through an emplyer also..hoping I would get my status changed.
The F 1 OPT got denied and now I ahve a H 1 approval without change of status...cos my grace period on F 1 expired with the RFE proceedings...

Please can anyone guide me what should be my best course of action:
Apply for reconsideration for my OPT?
Or just leave country and come bak with the H 1 B stamping? Are there chances H 1 B would be denied due to gap in status?
Please any help is appreciated!
Thanks..

you are not eligible for OPT, since you were out of status (outside the US) for more than 5 months. A period of more than 5 months wipes your slate clean and you have to start all over again - accumulating an academic year of enrollment before you can get OPT.
