Hi, I'm pretty new to this forum and I found this forum extremely helpful. I'm holding a F-1 visa and my wife F-2. Both of us are on status. She's now planning to apply for asylum, but we have already been in the US for 3 years. Is she going to be definitely denied if she applies for asylum? Anyone has the same condition with us?
Thanks!

I've come to know tons of people who've filed their asylum cases despite having lived in the states for over 5 years. Your case needs to be strong. Good luck.

I applied after being out of status for 10 years. The one year rule is taken very seriously. The Judge and the DHS attorney grilled me heavily as to why I did not apply within the one year window. You will need to show proof that circumstances have changed for the worse right now.
