I am on my 7th year H1-B extention which is till jan 2006.
I got laid off last month and I was with the same employer for near to 5 years.
My gc was filed and still in labor cert in backlog reduction center.

I have few companies willing to H1-B transfer, but to file a GC some have said I don't have 1 full year of visa. Is it true that i could not file new labor/gc?

I came across pre-approved labor options , but looks like they are not reliable companies and heard some bad news even in the site.

Please give any thoughts to keep me aware of the possibilites.
Thanks and Regards

First of all file a H1 transfer with the new employer. Then go ahead and file new LC. What they are refering to as 1 yr is that when it comes time for 8th year H1 ext, you won't have completed 1 yr of LC filing to get that 8th year. Here is the wayout, you can get that 8th year ext. based on your LC filed with the current employer. By any means, get the LC filing receipt from your current lawyer/employer if you already do not have it. That will be required for your 8th year ext. Your Lawyer/Employer will already have this receipt from DOL as they already processed your 7th year H1.

You should be able to find good employer to transfer your H1 to. If you run out of options, let the forum know and some one may be able to help you there.

Following is just a optimistic assumption, do not count too much on it:
If you file new LC under PERM, you may get it pretty soon and with the new Laws waiting approval, PD may become current by Jan2006 and you may be able to apply for 485 and save your status that way also.

Best of Luck!
