Old LCA or New LCA?

Hi,

I am working for a consulting firm in NJ which has placed me in a company in Chicago for 6 months project. My current H1 is for the consulting firm in NJ. Initially i had a LCA for my H1 for NJ region with a actual wage of 55,000 and a prevailing wage of 58, 000. As my employer was paying me less than the actual wage and i mentioned it to him that it might be a problem during my visa stamping. He got me a new LCA for chicago region(as my project was in that region) with actual wage $43, 000( that was what he was paying me then) and a prevailing wage of 35,000. He didnt make any changes to my H1 though. One month back i got a raise and he started paying me 60,000.

So my question is when i go for visa stamping to my country and when asked to submit my LCA, can i use the 1st LCA (ie, the LCA for NJ region), as it satfies my current wage or should i totally go for a new LCA. Whenever we apply for a new LCA, will all the LCA's approved previously get cancelled automatically? Beacause i had got an LCA for chicago region would my LCA for NJ region got have cancelled?

I would really apprciate any help on this.

Hi Ginnu,

Now because i got a raise of 60,000 per annum and according to the recent LCA i was being paid only 43,000 per annum. As the raise is more than 10%. Should i go for a new LCA for Chicago region (as i am still in that project) rather than the LCA which i had in the first place for NJ region (as my consulting firm is located there). Please suggest.

As Ginnu said, LCA for current location & pays equal of more than LCA wages is no problem.

That means your current LCA for Chicago is good enough as long as you get paid equal or more than the wages defined in that LCA. No need for new LCA.
