Old approved/expired H1b is reopend now after I-485 was approved around an year back

Hi Ginnu & other senior members:

My I-485 was approved & received physical green card around an year back.
However i have received an email from CIS stating that one of old approved(6/2001) & expired(3/2004) H1b was now reopened now reviewing their earlier decision on 6/20/08 (last friday) since i have my USCIS online case status portfolio have all my old H1b approvals, I-140 & I-485 cases attached with email alerts turn on.
There are no status changes & LUDs on my I-140 & I-485 since they were approved, per my signature details.

Has anybody ever come across this kind of weird email from CIS?
What is the point of reopening 7 years back approved H1b now after GC is approved? Do i have to take this email seriously? Does it have any impact to my GC which was already approved 11 months ago?

Pl. give me your valuable advises?

Did you do any fraud or wired things regarding this old petition (tax issue, multiple employers at the same time, salary issue……..etc)? If no, relax and take it easy. If yes, the USCIS can revise and take actions any time if any pertinent data appear whatever old the application is

Maybe your employer who filed the first H1 is now being charged with fraud, and so now they are revisiting all their H1 petitions. But don't worry about it now. Wait until you get something official in your snail mail. This could also be a big mistake. USCIS makes LOTS of mistakes.

mmed,
No i never did any such stuff with this old petetion. Infact, i have only worked for couple of months only in 2001 and move to another company in 2001 itself, thru which i got my GC. My question is what is the point of reopen a long time back expired h1b now after GC approval. Will this be a problem to the old company ( i have always maintained good relations with all my past employers) or to my GC status?

Jackolantern,
I have no idea about my previous empolyer company's current status as it was about 7 years back that i worked for them. Infact, i have only worked for few months in 2001 and move to another company in 2001 itself, thru which i got my GC. My question is what is the point of reopen a long time back expired h1b now after GC approval. Official notice will go to that old employer and their attorney only not to me, right? Will this be a problem to the old company or to my GC status?

Given that you transitioned from H1B to GC while with an employer other than the one whose H1B petition is being reopened, your GC should be OK even if they find that the original H1B was wrongly granted. Don't expect anything to hear anything from ICE/USCIS about it unless they plan to revoke your GC.

Hi Kvrp,
I just found out from my immigration department that they have requested to withdraw H1b since i got my green card. They are saying that probably thats the reason its reopened.

Thanks

p76,
That makes sense. I thought your old H1b was expired or not a recent one that was reopend. Did you see any LUD changes on your I140/485 cases?

In my case the reopened h1b was 7 years old one, which was expired also 4 years back. Per my attorny, this could be due to incorrect online status message as the attorny himself saw it happens to many of clients. I hope this could be an incorrect status message as mentioned by my attorny.

May be USCIS online status error or may be the Past employer A is being investigated and May be Past employer did fraud or kept H1B holders on Bench and did not pay, may be some past or present employee sent complaint against employer to DOL to recover the past or present wages and info went to USCIS. In past many abused H1 Law/regulation.

If you did not submit any fake certificate/exp letter/degree certificate to get H1 or at the time of LC/I-140 then you need not to worry.
You Transferred H1 to B and B filed LC or I-140 for you and you filed I-485 based on B I-140 and got I-485 approved based on I-140 filed by B.
** The company being investigated is from NJ????

Hi ginnu,
Thanks a lot for your detailed reply.
No, i didn't submit any fake stuff either during that old H1b or LC/I-140.

Yes, i have transferred that old H1 from A to B (after 9 months only), then from B i have applied and got my GC. Infact while i was working for B (3.5 years) i have applied my GC, got I-140 approved, I-485 filed 15 months back by then, then joined the client of B with no objection from B. Then i got my I-485 approved just an year back while i am still working now with the same client as FTE with which i have started the job with B.

No, The company being investigated is from CA not from NJ.

Again, thanks a lot for your reply.
