You did not hear any thing from INS? It is pretty strange. It should be approved by this time. Did you get any REF?

So far bno luck. No RFE, no change in message, I\'m really surprised. Thanks for asking/concern. How is your CP thing going? Did you apply for PCC?

You have to opted for EB3 for I-140. I hope will work. What I did --->
Mine was also EB2(BS+5) but I filed my with EB3 becoz I saw a lot REFs in past for EB2. That\'s why I opted for EB3. If you have Masters then it will not create a problem but If you are BS+5 then they send some REFs. I am still not sure why your case stucked with INS.

Thanks. But I think its too late now or can we change EB2 to EB3 now? I have BS + 5, actually BS (Comp Science) + 9. I have provided reference letters with progressive exp, last 3 pay stubs, last 3 years (probably 4 years) W2s, company tax return, education evaluation certificate (not for experieces). I don\'t know what could make it stuck there. Only thing is mine company is a very small and may not have much history of GC processing. Could it be a reason?

My case still pending but I don\'t think it is caused by RFE. I think maybe RIR or non-RIR affects the speed. It is normal there is one month time difference. If there is RFE, at this time, we should get that message. How do you think?

Yes , You sent every thing whatever is possible and looks pretty strong case . Same docs I sent for my I-140. I do not know what is wrong with your case. Yes It is too late to opt for EB3.
Did u talked to any IIO yet? If not please call and ask them ?

Does RIR/Non-RIR affect I-140 processing!!!? I didn\'t know that. If you know in what way it affects please post it. Mine was RIR. You mentioned one month, do you mean that RIR cases take one more month then non-RIR? Please post.

Does not matter it is RIR or Non-RIR. Mine was RIR case. It may depend on EB1/EB2/EB3/EB4 etc but not definately on RIR and NON-RIR.
And even does not make any meaning of it.
Talk to IIO and find out about the case status.

Could you please post the information like

RIR, Non RIR
Company Size (small 1-50 employee, medium 50 - 200 or large)
BS + 5 or MS
Did you send company tax returns?

etc. I\'m trying to understand the logic behind holding off some cases and approving others (with RD/ND in Nov, Dec). I know INS doesn\'t know the logic but still try to analyze their pattern.

Yes that could be reason. I checked in instrack.sce.net that recently James Smith got RFE for BS + 5, and several BS + 5 cases are hanging in there without RFE, some with RFE. But in august RD/ND I see many approvals for BS + 5 EB2.
