IMO, we should see some movement after 10/1, because TSP register will be done, those officers will be back and pickup left over cases.

My wild guess is, our cases were half processed(then officer were assigned higher priority works) and have to be picked up by the same officers who started the process. If they are not assigned back, we will not see movement in our thread.

Petition On Behalf of October Filers

Hi All:

I've drafted a petition on behalf of our October filers to the
Director of the Vermont Service Center. Please read it
and post your comments.

I plan to send it by both fax and hard copy letter with
signatures of all of us. I guess we have to meet in order
to sign the petition with specific RD, ND, etc. info. Anyone
can tell me the direct fax # to the VSC?

Dear BCIS Vermont Service Center Director:

This is to request your immediate attention to an urgent
issue related to our I-485 applications. We, as applicants,
have suffered from tremendous emotional stress and financial
loss as a result of a severe delay in processing our applications.

We filed our I-485 applications as early as October, 2001.
However, we have never been granted our green card approvals.
Most of those who filed their applications at about the same time
and share a similar background were granted their permanent
residence status almost one year ago. Even those who filed their
applications as late as year 2002 have received their approvals.

The waiting time for our I-485 applications is over 22 months
so far, well beyond the maximum processing time limit. Even
more than two months after we provided a second fingerprint,
still there is no news. Contrary to our unfortunate situation,
approval notices are received every day by those who filed
their applications at a much later time.

During this unreasonably long delay, we contacted the former
INS multiple times for a status update. We would get a standard
answer each time - "if you do not hear any news in a month or
two, call back." However, we never heard any news. To make
the situation more difficult, the Vermont Service Center has
recently cancelled its customer service phone number, and we
now have no chance of even speaking to an officer about our
severely delayed applications.

Due to the delay, we have to redo our fingerprints, extend our
EAD documents, and apply for extra Advanced Parole documents
for travel. These not only cost time and money, but also cause
significant emotional strain and agony.

Perhaps we are victims of the reorganization of INS, now within
the Department of Homeland Security, and a disorganized
security check process after the September 11th incident. During
the transition from INS to Homeland Security, and the addition of
a security check process, there was a "hole" created in
operational procedures that has deeply affected a small number
of individuals, including us.

So therefore, we respectfully request your immediate attention to
our applications to avoid any further delay and emotional
suffering in the interest of fairness, equal opportunity, and good
conscience. Your prompt response to this matter is vital and
would be very much appreciated!

Hi All:

I imagine they will ignore this petition again in the same way
they ignored the last petition sent by Rajiv on our behalf.

If that's the case, I'll deliver this petition in person to the VSC.
I'll make sure they read the petition. Do you think that's a good
idea?

Thanks for the draft.

Regarding contacting the director - it will be great if we can meet him personally. If we cannot then we can Fedex the petition at director address on the website.

For signing the letter shall we have a separate page which will hold our :

Finally the sheet can reach either you or me. Whoever undertakes the responsibility will be entrusted to sincerely & correctly Fedex it to VSC. Any cost can be split up once we are done with the mailing part. We can discuss this over the chat.

I agree to most of your suggestions. The only thing is I don't
know how to enter the chat room on Tuesday. Can you
advise me on how?

Either you or I can send the final letter to the VSC. Doesn't
matter. I'd be happy to take care of this, BTW. We need a
receipt for each activity in order to calculate the cost.

I'll create a signature sheet for everybody to put on their
Receipt #, Alien #, RD, ND, etc. in a Word format. I'll post it
by tonight on this thread.

Hi Clueless123,

One more alernative. Can we type in the signature sheet without
having to sign it.

Only one person will sign the main letter on behalf of all ? This will
save us some time.

Rest of the data can be either sent by all members via email
or private message. The final signature sheet can be sent to all
the members for review. Once every one confirms their info -
we can file (FEDEX) it with return-receipt (confirmation
from VSC director's office that they recd it) option. Those
who wish to recv this confirmation copy can send self address
envelope and recv it or via fax. This will be to maintain records.

I have sent invitation to you for yahoo chat. Rest of the
team please either create one so that we can chat on Tuesday
at a suitable time 8 pm ET (?).

I think it a good idea to get the signature sheet without
signing. In this way, we avoid hassle.

I'll gather all of the yahoo ids from Oct filers and send
out a template in Word format to all after I get the yahoo ids.
I'd like to chat at 8pm Tuesday. Since I've never done this
before, please let me know how to chat online.

I'll post the template for signature to this thread later tonight.

At the same time, please review the letter to let me know
if I need to make any changes to it.
