Hi,

I got my I-140/I-485 applied through a company XYZ for future employment. I never worked for them. Presently I work for company ABC even before filing I-140/I-485. I work in the same or similar job and earning more than what was described in the Labor. Here are my questions:

1. Can I file AC21 supported by my current employer ABC ?

2. Are there anyone that filed AC21 who were in above situation. If so, have you got yours approved or had to face the interview. If faced an interview, what were the questions.

3. Is the probability of getting I-485 rejected more in the above scenario?

I forgot to specify that the other conditions are satisfied viz.

1. I-140 approved and
2. I-485 is pending for more than 180 days. :eek:

---YES, as your I-140 is approved and I-485 is pending more than 180 days

------ nothing much is asked in interview, only recent letter of employer, recent 3-4 pay stubs 3 years tax filing and they provide list of documents
3. Is the probability of getting I-485 rejected more in the above scenario?
--- I dont see why the I-485 will be rejected, you have similar permanent job offer from ABC, send AC21 letter and invoke AC21

One question at interview related to your situation, as described by another poster, who recently got approved is:
Have you ever worked for the sponsoring employer ?
Search for that post... its a good one, you will love it.
 
AC21 Question

Hi Gurus,

This is a wonderful form with tons of information. I have been a silent reader.

Have sent in the AC21 along with the required docs as described in the thread to VSC in the month of Feb' 15th 2005. Till now there is no LUD indicating that the case has been updated. But have the confirmation email from Fedex that that package is received.

Any one who has applied for AC21, not changing the status is it normal or will the LUD be changed.

Please advice me as it drives me crazy.
