aos question

Greating's

Wanted to know if any one can provide information about this i 94 status , my wife came here on marrage visa , well , my question is would she be conciderd illegal if we dont file for aos after the i 94 runs out of time, im asking because i understood that it was only for marriage .

I was also told that she woulndt be conciderd illigal , she would simply be out of status and woulndt be able to find work because of no green card ect ect .. we intend on applying for aos but money is abit low

From my understanding if your I94 has expired, you are out of status therefore you are here illegally.

So overstaying is allowed or it's illegal. Or overstay is for a certain no. of days, then it turns into illegal?

technically, as soon as I-94 runs out, their presence is illegal unless other application like change of status, extension, or AOS are pending.

That's what I thought, but then again I thought your first response was saying the contrary.
