NVC or INS...not sure who is at fault...

My mom filed form I-130 for me and my younger brother about 4yrs ago...he was under 18 and I was over 21.

90 days after she filed...my brother got his work permit and shortly after...his green card...it took 4yrs for me to get anything from the NVC...

A couple of things to note:
We live in the US (and have for about 14yrs now)...
I started out with a visiting visa, then renewed my student visa twice and was told I had to go to my home country to have it renewed again...by then...my mother was naturalized so she just filed for us both...

Now...NVC has my paper work going to a country in Africa...not sure how that happened...since I have never been to that country, it is not my place of birth, nor am I a national of said country...
Yet, they have sent my paper work to the US Consulate there...?
I called them...and somehow...they wont give me any information on the application because of course...my mom filed it...she calls and they SOMEHOW have her DOB wrong...which is odd...because she sent copies of her passport and her naturalization certificate when she filed for me and my brother (who has had his greencard for 4yrs now)....

So...now, they are saying that even though we payed $70 for the Affidavit and the $400 for DS-230...we need to file AGAIN to regularize status in the US????????

I'm sorry...that does not make any sense to me and I couldnt believe the rep that I talked to spoke those words out loud....

I called INS and they confirmed the information they sent to NVC FOUR YEARS ago was correct...

Now what do I do? NOBODY seems to know what I should do! Short of driving to NH to speak to someone (which I doubt would do anything more than get me placed on the terrorist watch list and summarily DEPORTED)...what are my options?

We've invested so much time, money and effort...surely there are ways for them to fix their blunder? Can they and should they not be held accountable for their screw up?

Is anyone else having this issue with them? I have lost so much time to this...I mean...I dont even have a work permit?!

I am so frustrated....I tried to get an attorney...and after he took my money....he told me the same thing they did...is that right????

I dont understand how ONE woman can file for her children...one gets it in no time...the other one somehow gets rerouted to Africa...waits 4yrs and now has to wait another what? 4yrs??????

This just isnt RIGHT nor is it fair...I'm so frustrated and upset...:mad:
 
So, what is your status now in the US? What do you mean by "by then...my mother was naturalized so she just filed for us both...
"? Just because you mother filed a petition for you doesn't mean you didn't have to maintain your status.

If you are in the US, how did you get to FILE AND PAY FOR DS-230? Do you even know what DS-230 form is for? If you haven't been keeping your status intact while in the US, you can't adjust your status to permanent resident, you need to go back to your country - and depending on how long you stayed in the US illegally, you might be barred from coming back in for 3 to 10 years.
