NSC Not Touching Concurrent 140 Cases

VSC seems to be on cruise

VSC seems to be on a cruise ,they have started approving
Dec cases now .Its about time that NSC wakes up!!!!
 
I dont think it is ordered alphabetically. NSC just pick cases randomly.

Looks like another week is going to pass without any action.Why doesn't NSC issue a statement why they are not approving any concurrent applications.If you are not going to approve applications,then say it.Atleast that makes the process transparent and we will stop expecting !!!! :mad:

yes this is all so frustrating.
 
True

This is absolutely frustrating. Checking the site every 2 hours if there is any update. They should give a report on what is going on or take some steps to make things move. Keeping mouth shut is making thousands of applicants only tensed

Guys,

Once NSC start approving concurent cases they will approve both 140 and 485 concurently and hence NSC might have thought they can make us wait for sometime because anyways we are going to get 140/485 concurrently approved so instead of earlier wait time of about 2 years for 485 they thought we can wait for atleast a year or so for both 140/485 together meanwhile they can approve other types of cases.

This is my speculation...what do you guys think?

I dont think that can be the case reading the memo. That memo is for filers from Apr 2004. What about we guys from Sep 2003 to Mar 2004. If that being the case a new memo has to be out making things clear insted of making things confusing by keeping mouth shut
 
Friends, you all have to thank me for finding out why our cases are not getting processed now.

As we all know, Initially the I-140/I-485 were supposed to get process together. Now in order to reduce MORE BACKLOGS, they have decided to process I-140/I-485 and also N-400 (Form for citizenship) at same time. So till you file your citizenship papers, nothing will get processed.

As usual, Just Kidding. :D :D

Isn't NSC processing I 485s upto Dec 2002?

Wasn't there an announcement from NSC that they will first catch up with the I485 filed in or before Dec 2002 and then start on the concurrently filed cases in 2003? Although they are processing some cases from Nov and Dec 2002 (see the I485 thread for Nebraska), the processing date for I485 is still Feb 2002. So I think all of us should just accept our fate and chill out!
 
There is a beautiful song in an Indian movie titled 'Lagan'. This song is enacted 2 times in the movie. The first time the scene results in sadness and the next time it results in happiness.
"Ghanan Ghanan Ghanan..." Basically the song is sung in anticipation of a deliverance from the long spell of drought, the deliverance in the form of a rain.
Lets hope this silence is the song sung just before the delivering storm and not a damning storm.

I guess the memo is not very clear few of them interpret it as "cases filed after april 2004" and few others as "from april 2004 concurent cases will be adjuncticated concurently" so nobody knows....what is happening or what their game plan is.......

Thank you naashi....one last question though....

Can you give us a guarantee that citizensship would be the last step...wont they be asking us to fill in the applications as when we "ALIENS" would be departing Earth so that they can process that application along with all the pending applications?

Why NSC is not approving I-140

Look at the PDF document at http://uscis.gov/graphics/aboutus/repsstudies/BEPFinal-signed.pdf
They have posted the backlog "elimination" (or creating) strategy!.
As per the document if you see a table far below in the document they have set the target for FY2004 for I140 and it is 8 months. But these 8 months is average. By approving some cases in 22 days they have maintained the average. Thats why we see some people in 2004 getting approved while lot of people from 2003 are still waiting. They hand pick some application from each months. They are doing the same for I485. They are approving some sept 2002 I-485s while some others Jan, Feb, Mar, Apr...2002 are still waiting.
They are playing these game to show congress that average processing time is not so bad.
USCIS should not be able to process new applications untill they first clear the backlog of long waiting cases. That will reflect correct average processing times.

IMHO:

Recent actions taken by the nsc seem to support your message. Do you remember reading any such official article??? Judging by the approvals, they seem to have engaged full swing in reducing backlog of old 485 cases. In other words, they are going right against the Ohata memo.

One more thing, I see a lot of people concerned about the uscis processing dates not getting updated. I can see why - Since most lawyers prefer to not contact bcis until the processing dates have moved out 30 days after your receipt date. This could be one strategy to keep everyone quiet by not updating the dates. Although the website says Feb 02, I have seen several applications from 02 and 03 get processed on rupnet and other sites.

I think real time indicators of approval would now be much more reliable than the published processing dates.
 
According to the backlog elimination strategy, the average processing time goal for 140s by end of sept 04 is 8 months, so the processing dates should be January 04 by then. I don't see that happening unless they start working on I-140s on a priority basis!
Their goal for I-485s is 20 months, meaning they should be done with cases upto Jan 03 by end of September..doesn't seem like this will happen either for NSC.

Key here is the average is across centers ...so NSC is probably counting on overachieving centers like VSC on picking up the slack so they can continue their slothful ways.
