Not able to proceed with I-485 because of salary differences

Hello Everyone,

When my employer files for Labor he quited the projected salary. Unfortunately, because of slowdown , my employer has in effect a policy of no salary raises for last 2 years. I came to know about the different salary on my Labor only after I-140 was approved. Now my lawyer is saying that they can not move further until my salary becomes same as on Labor.

What options do I have now ?
 
I think you can move...

the idea is that the employer has to pay the salary AFTER the 485 is approved. So you can get a letter from the employer that he will pay you the salary after your 485 is approved.
 
Thats fine. Tell them that the salary on the Labor Cert is the projected salary after GC approval. That is often the case with most GC applicants.

I have heard that if the current salary is within 95% of the salary stated on the LC then it should be "Ok". Can anyone please point me to INS regulations or other sources with more information on this?

BTW, my employer is not willing to commit to increasing my salary to match the amount on my LC. The company-lawyer (so firing and hiring a new one is not an option) is not willing to go-ahead without a committment from my employer. I don't know what to do....:(
 
salary decrease since lc

my husbands co. slashed salaries by 10% across the board late last year - after we had filed for I 485 =-will this be a problem when it comes to approval which we are expecting ( hoping) any day now ?
 
If there is some differences in Salary, that is not an issue with GC process. However if there is significant differences, this may be an issue with IIO processing your case. They may not reject your case just because of this. Why can't have lawyer of your own. This makes life easy a lot.
