My wife (Canadian Citizen) and I applied for NEXUS yesterday.
I am a citizen of the Netherlands. In 2007 I got turned around at the POE in Florida - they believed I was living in the US on a B2 visa so visa was cancelled and I got turned around.
I didn't attempt to return to the US for 5 years. I am now a Permanent Resident of Canada, and was issued a new 10 year B2 visa at the Ottawa Embassy.
During the Visa interview, the officer informed me that I had an overstay recorded. He said not to worry about it, but gave me the dates they had on file.
When I went home, I looked up my email confirmation for the flight I took to leave the country. It appears that USCIS never recorded my EXIT on May 9th, 2007. My Entry Stamp was valid till May 10th, so I did not overstay.
Instead, they recorded my exit as May 14th, which was the day I got turned around, upon RE-ENTRY to the US. I had been gone already for 5 days!
I voluntarily withdrew my application for entry and my visa was voided. Is this in itself grounds for not approving NEXUS?
If that part can be overcome, then the only thing I am concerned about is that I have an incorrectly recorded overstay on record. How do I prove that I didn't overstay? It was 6 years ago now. Martinair no longer offers passenger flights, and when speaking with a KLM customer service rep she informed me their records don't go back to 2007 so she's not sure if I can even get confirmation that I boarded that flight.
I don't have any credit card statements or anything that could prove my presence in Holland for that period. Obviously as an EU passport holder there are no passport stamps stating I entered The Netherlands.
The only thing I have is a flight booking confirmation from CheapFlights, as well as a rental car booking from the same site. I have photos taken during that period too, but no way to prove those weren't taken in the US, nor are they date stamped.
Would proving I did not overstay make me eligible for NEXUS? Or was the fact that my visa was cancelled at POE completely preclude me from it anyway?
I have, since obtaining a new Visa, entered the US for day trips twice with no issues. The only reason we want NEXUS is because waiting almost 2 hours for an I-94 just to cross the border for dinner or some shopping is ridiculous.
In 2.5 years I'll be a Canadian Citizen and crossing will be quick and easy again - but if we can enjoy border crossing before then by having NEXUS, I know it'd certainly improve our quality of life, as we frequently want to cross the border but decide not to because of the hassles.
