I've looked all over (including numerous FAQ's) and hopefully I stumbled into the right place.

I recently married a Venezuelan, and we are in the process of filling her paperwork to become a permanent resident. She is currently under a student visa (F1), and I am a US citizen. I didnt realize how confusing this is, so here is a specific question:

On I-485 which Application Type are we seeking? None of the letters seems to fit our situation. The closest that would fit, is "b" but I havent applied for anything. Do I just fill out "h" and put that she married a US citizen?

Also, we recently came back from the Bahamas and we did immigration over there. On page 2 it states, "place of last entry to the US". Is that Nassau since we did immigration over there? or our final destination (Atlanta)? Her I-94 says "Nassau".

Any help would be greatly appreciated.

1. On I-485 you mark A, since you are filing I-485 with I-130 (visa petition), which will give her an immigrant visa number immediately.


2. What does "we did immigration over there" mean? What was your first port of entry in the US? Atlanta? Then, it's Atlanta.
 
Thanks for the reply to the first question. Its very confusing. I would have never imagined it was "a".

On the second item, "immigration over there" means that they stamped her I-94 over there and when we arrived in Atlanta we arrived as if we had gone on a national flight (no need to go through customs). Also her I-94 says "US Customs and Borders Protection NAS 2004". But I have my doubts about putting Nassau, Bahamas as a City/State of the US.

These are complicated processes, I would suggesthiring a professional to help you for several reasons. One is you dont want your wife being deported as a result of an overstay, and two if you do anything wrong you will turn what is a 9 month process into a two year process by way of Rfe.
