45 day letter

hello all
Received the "45-day letter" yesterday. my filing date with ny labor was FEB-01-02.
Hoping to send in the response in the next few days.

I have a PD of Jan 2002, NY SWA RIR (Software Engineer)

From the time of filing, my salary has gone up about 25% from what I had stated in the Labor Application.
But my Designation still remains the same.


Will this cause a problem in the I140 or I485 stages.

No it will not be a problem.

As "optimism" stated, it SHOULD BE OK if nature of work is the same but it does open itself up for interpretation.

no, but I sent an email to my lawyer asking for that info. will let you know..
fyi, when I sent an inquiry to h1b7y (Sep 12th), my case status was still incomplete with a "T" case number. That probably means they worked on completing my case after that date.

Did you manage to file for your 140/485 before Sep 30? Considering that you Labor approval date was Sep 6, you should have....unless ur lawyer DOL screwed up and did not inform you in time...

Labor Approval notification received last week of September.
Not very logical, but in my case, there was less that a months difference between 45-day letter and actual approval. Nothing makes sense anymore.

This is just retrogression.

Nothing specific to BPC.

I think your case and my case are sitting in the same box.

I agree... Btw, I decided against sending an email to inquire for status in late August, b/c my firm and my attorney (Fragomen) are to do it in the next couple of weeks (my 6th year expiring in April '06). I figured since I've waited this long, maybe I'll get more info. I just need to make them (Fragomen and my HR) send me the screen shot once they receive it. As I have said before, they are not very cooperative. So far my case has been a black box to me.

My lawyer received the letter last friday (no idea what the actual date on the letter was). I also sent a query to H1B7Y and this time, it looks like they've completed all the fields and switched the case id to "P" instead of "T" (kept the same number). Case status is "Data Review".
will provide you with an update a month from now (don't like jamming the h1b7y..).
