Notice of Findings

Hi,
I got a "Notice of Findings" from NY DOL. My Employer told me that this is related to prevailing wages. Can you guys tell me how many days/months/years it will take once my attorney reply to that?

Here are my case details:

NJ State Filed: Apr 2002
Forwarded to NY DOL: Aug 2004
Entered into system :Sept 24th 2004
Case # 02-510-XXX

Do not worry, once your employer replied for query it gonna take hardly couple of weeks to certify case. keep your fingers crossed.

Thanks njrirlabor. My case # is 02511*** and still pending.. I spoke to the person at NY DOL, he said it would take atleast another 1-2 months. cannot understand their logic.

So did u apply for your I140?? what about I485?? no concurrent filing rite??

Even my Case # begins with 02511*** , It was entered into NY DOL on 24th Oct.
When was yours entered?

My case was entered in March 2005. There is no logic to what DOL does. But it looks like they are approving cases atleast. I had a major RFE from state, but my lawyer somehow handled it.

Planning to apply for I 140/ I 1485 in the next couple of weeks, getting all the paperwork ready currently. I am filing concurrently. I am not too sure as to whay you mentioned no concurrent filing? I am EB2, which has not retrogressed as yet.

I filed August 2001 in New York, case was transferred to Regional NY DOL on August 5 2004, NY Regional DOL receipt date is October 1, 2004, case # is 02510xxx

My attorney obtained a NOF dated July 12.

My data is absolutely the same as yours, including case #.
The guy from NY Regional DOL told by the phone yesterday that an answer should take another 5 weeks.
Can you please describe what is your "NOF" about?

Hi, my NOF is related to the acquisition of my company and a resulting name change of the employer, which occured during the 4 "short" years my LC application has been pending, and seems to be confusing the hell out of our friends at the NY DOL.

Congratulations! It looks like NY DOL is finally getting their act together. Are EB2 or EB3?

Mine was entered in NY Regional DOL at Oct. 12th, 2004, which has the same DOT code as you.

Do you hear this from your lawyer or your company? I hope I can get mine soon!
