New revalidation times ( Jan 22, 2002 Onwards)

Revalidated visa with checked criminal case "misdemeanor"

I have been a quite follower of this news group. Just to share experience of one of my collegues

Passport Sent from Lawyer=11/08
Passport Recevied with valid stamp=01/24

Since my collegue had a minor "misdemeanor case - shop lifting under $25", lawyer recommended to check the criminal case box in the form along with a certified copy from the court and today we received the good news of revalidation.

I just wanted to share it, since some of us have been involved in cases like DUI, domestic violence etc. My lawyer opinion is "we should always state truth", since thats what we sign at the end of the form. If we misled DOS/embassies and they find out, foreigners are liable for a deportation. I am very glad with my lawyer guidance.
 
Processing Time

As you all get your passports back, would you please post processing dates. This will really help others to track timing and plan future trips outside US. Thanks.
 
Latest info about Visa Revalidation

Just to let all you guys know -
#1 My wife\'s friend got her passport back just today ie, 01/28/2002.
   She sent her application on 11/20/2001, received by St. Loui on
   11/21/2001, stamped on 01/24/2002 and passport received on
   01/28/2002. So it took 69 days OR 9.85 weeks.
   I hope this might help.
#2 I called Dept of State at 202-663-1225 and asked about the status
   of my application. Thought others were asked about name, DOB and
   were told their status (came to know from this forum only)
   ,in my case she refused. She just told me thay they are working
   only on Nov. cases and it is taking 12-15 weeks. But the DOS
   web site says its taking 10-12 weeks.
   Considering all this and #1, what guess you guys have for my case?
   I have to be there in India by 02/25/2002. What is the best bet?
   How long I should wait before withdrawing my passport?

It happened to me too. The reason I was calling them was to check whether my passport was in the anthrax bag. The first officer was not at all paid any attention to my question and all she asked me when I sent the passport.

I called again and this time the other officer was kind enough to listen and she checked whether my passport was in anthrax tainted(it didn\'t) and she told me that I should receive my passport in another 2 weeks. BTW, I sent my passport on 5th Nov. and received in St. Louis by 7th.

It takes atleast 2-3 weeks(from the discussion this site has) to withdraw the passport.

Officer at Dept. of State didn\'t help

Hi Raj

After reading your reply, I called Dept. of State again. Call
it my bad luck but even in 2nd time, the lady didn\'t ask any question
specifc to my case. I told her that purpose of me calling dept. of
state is that I want to ensure that my application did not get lost
in anthrax tainted bag. She asked about the date I sent my
application to them and replied -
"Don\'t worry you are not affected by this"

When I tried to further ask about the status of my visa revalidation
application, she refused saying its not possible.

Now, I just want to know, what exact question you asked 2nd time?

Finally, I am very confused. You sent your visa revalidation
application on 5th Nov and still it is going to take 2-3 weeks and
on the other friend of mine sent it on 20th Nov and got her passport
revalidated today.
How come a person like you who sent his application much before is
still waiting? Looks like Dept. of State do not work on applications
serially (in the order they are received). Or may be there must be
some other factors that we don\'t know.

ANY BODY WHO CAN THROW SOME LIGHT ON THIS ?

PS: The recording at 202-663-1225 says that its taking at the most
    15 weeks to get visa revalidated.
 
Visa Revalidation -- Passport sent to St.Louis

Hi all,

I had sent my passport to St.Louis on the 19th of October 2001 and have still not got my passport back..

I am starting to get nervous. Did it take anyone so long ??

Should I wait for some more time..

Please advice.

Wait till 15 weeks are over and then call Dept. of State

Hi Kings

I think you should wait till 15 weeks are over.
Once 15 weeks are over (since 19th Oct, 2001), I
suggest you call DOS on 202-663-1225. At that time
they won\'t give a generalized answer like its taking
12-15 weeks so wait. Your argument that 15 weeks are
already over should make them to check your specific
case in their computer.

update ...

I just talked to DOS --- The officer was very helpful... It\'s being processed now -- according to her it may take another 2/3 weeks...

Kinda Odd !

Because someone with mailing date 11/10 and even 11/28 have received their passports already.

This is what I asked the officer the second time :
"Recently, I heard the news that some of the passports are held, because of the anthrax threat. I am calling to check whether my passport is in that list.".

The officer asked my last name and the date of birth then she had put me on hold and came back in a minute and told me that mine is not affected and I should get it back in 2 weeks.

BTW, I checked my post today, they sent my passport yesterday in USPS overnight express. I have to collect it.

Also, I heard( it is not very particular), that the processing depends on the case officers assigned and different people have different speeds in processing the stamping. So I wasn\'t alarmed too much when I read, your friend got the passport ahead of me, but I thought of giving the DOS a call this friday if I don\'t get the PP by this week, which is now, unnecessary.

Anyway, thank you for your thought.

revalidation - stamp expired for more than a year

Hello,
I read on this website that one of the conditions for sending my passport for H-1B revalidation to St. Louis is that the previous stamping should not have expired for more than a year. Does that mean I have to get it done outside US? Can anyone point me to a definitive statement on this? Also, what documentation is needed for this if applying outside US (in india).

Yes

Yes, You cannot send the passport for revaldiation if Old VISA in your passport expired more than a year ago.
 
misdemeanor case reply - Asic Chip - Pl reply

Hi,

In above update, I had a same case before I filed I-140 but I did not shown it on I-140 application nor on re-validation (both process are still gogin on - I 140 ND 21st July 2001, sent for re-validation before a one week)
I have not shown as I have done expungment of that case ( All record will be there but will be removed from the public view only; available to upper/higher authority)
Does this is OK what I have done ? or I should have given all that info on all form inspite of my expungment ? I have not consulted my or any attorney !

M/W my old stamp has already expired 01/02/01. It is
one year from expiry starting 01/02/02. Don\'t know if
DOS will stamp my passport... Did anybody have a similar
situation or your inputs please....
