5. Approve Permanent Resident application of dependents if the primary applicant deceases :
During the Adjustment Of Status (AOS) period, if the Primary applicant dies in some unfortunate circumstances, then all the dependents are denied the Permanent Residentship and removal proceedings will be initiated against them. This is very unfortunate bacuse in some cases the children might be in the middle of their college degree and they will have to abruptly discontinue and abandon their American dream. We request you to change the existing laws so that, during the Adjustment Of Status, if the Primary applicant dies six months after the date of Receipt, then the dependents applications should not be rejected. The dependents should not be punished for the processing delays at BCIS.
 
We are asking for Interim GC I do not know why it should be after six months of filing 485.

If they need to see the papers again after six months then there will be a back log even for interim GC.

My suggestion is that the day they give us the ND of I-485 they need to check all the papers and give us the Interim GC.

If six months time is given then BCIS will never open our case and again there will be delay for Interim GC also.

Just my opinion
 
Interim GC

Hi mssjan03,
Actually, i have deleted that request because of complications and disagreements surrounding it. We thought that congress will be reluctant to pass such sweeping changes. But if we request for an interim (short term) GC when BCIS first looks into our papaers (check encashment time) , and if congress passes it, then that will really be great. It's not a big thing for BCIS to do.

Second point has to stay since there are couple of legal immigration reform bills which proposes GC for any legal immigrants after five years of legal stay in US, so this point goes with the legal immigration reform bill (Bill- GC after 5 years of legal stay, Proposal - Citizenship after 8/10 years of legal stay ). Rephrase that but it has to stay.

5 years from the moment I-485 is lodged, or 3 years from the day I-485 is approved, or 8 years total legal stay, whichever is shorter. That means, 6 years total legal stay may be eligible for citizenships if one submits I-485 one year after he arrived in the country. Anyway, 5+ years without a political life (paying the tax, being unable to vote) is still too long. Remember, Mr. Bush's wallet is partially funded by our tax money.

It' time to finlaize the letter/petition. PLease publish the 1st draft so everyone can have a look and comment on it.

BTW, I think I-485 is completely superfluous, which is now taking ridiculously long time. Why do we need I-485? Once you pass Labor and I-140 your are approved for a GC visa. We should have GC in a few weeks. RFEs for employment, etc. are a joke in I-485 stage. They should further simplify the process by combining I-140 and 485 into, say, I-185. That's what some other countries do. Once you are improved for a GC, you just go there and get your passport stamped.

You are right that issuing GC is only a 5 minute work once our I140 is approved. BCIS is using the Security check excuse to cause all the delay. The reason why we did not request BCIS to issue GC at the time of check encashment is that BCIS will reject that demand in the name of security checks. But we need to launch an attack on BCIS for using this excuse to turn a 5 minute work into a 2 yr work. Let's explore it.
I will publish this petition in a separate thread by noon today for final comments. Then we will send it to Rajiv tomorrow.
 
precisely. i fully agree that 485 is unnecessarily redundant...

the only steps in 485 are security check, name check, medical and see if the applicant has an approved 140 (except for ac21). and in the 4 steps the first 3 are not even done by bcis. so why are they saying processing takes time?

fbi takes 2 days to send FP results and the name check takes some 60 days i think. these 2 steps are independent from what bcis does. may be for FP, they should have a online system where the applicant him/herself should make an appointment for FP with his src# and give FP (much like the online process for EAD).

the 485 shouldn't take more than 3 months to process this way. also, after 6 months they should make amendment such that the 485 cannot be denied other than security or medical reason (like no more employment rfe, or death of primary etc). this way almost all of 485 applicants will not file for EAD and AP. may be they can increase the application fee for 485 to include this fee too, if money is a problem.

Looks Good. These are just our request, Lawmakers have their own ideas. So let's Send to Rajiv ASAP.

Timing is more important, if you remember AC21 it was signed by President in October 2000 just before elections. It would have been introduced in the congress sometime in early 2000. So this is just right time, so let's keep the ball rolling.

Once the petition letter will be finalized,
I believe every one should send it to one's Congressperson or Senators and start discussion based on the petition.
Of course, the letter with lots of signatures will be sent to them later,
however, we should start contacting each Congressperson and Senators right now,
because one of them has to introduce a bill.

I'm not sure whether the copyright of the lettter belongs to dsatish or not,
but if you don't mind, I would like to bring it to Congresswoman in my district to discuss about the bill to be introduced.

The letter belongs to the community/forum. The plan is to send it to ALL Congress/Senate. Wrt our local ones we can write our personal story. One could use the AILA's facility to locate , write and send from there.

This Petition is already sent to Rajiv and Rajiv has already taken a look at it. Ofcourse, this does not prevent us from making improvements this petition.
