New passport for wife with updated surname-stamp H4 again?

My wife is visiting her parents in India and her passport is about to expire later this year. During the renewal of her passport she has also decided to update her surname (she has the marriage certificate).

Her current passport already has a H4 stamp with her current name and is valid till the expiry of my H1 visa (2012).

After she gets the new passport does she have to go for H4 stamping again? Or can she travel without new stamp carrying both the old and new passports?

Your replies are greatly appreciated.

Thanks.

if she changes her last name/Surname then her new passport will be having her new Last Name/surname and the H Visa stamp she has on passport with other name.
FYI Airline ticket is booked with passport number. I dont know if she will be admitted to US with different name of Visa stamp and different name on her new passport. You MUST talk to good lawyer.

Friends,

By the time my wife went to apply for her new passport the wait time was over 2 months (for Tatkal) and even longer for normal processing. Also there were couple of days when the passport office was closed due strike.

Instead she traveled with her old passport and did not have any problems re-entering at Chicago. We had email the US consulate in Chennai and they replied saying that the US and India had a pact where we can travel even if the passport validity is less than 6 months.

So we decided to apply for her new passport here in Chicago, with the name change.

Check her Latest I-94 expiry date. if passport was supposed to expire in 2-3 months then she will have I-94 till her Passport expiry date and not till H4 visa stamp expiry date.
Till what date is her LATEST I-94 expiry date?
Till what date is her H4 visa stamp validity?
** if both match then no problem.
