My I-485 has been stuck in name check with FBI for over a year and a half. I am exploring the possibility of a job switch. I understand that I can go through the AC-21 process once I join the new employer as long as my job description and title remain the same as job duties on your LC (from ETA750A item13).
The challenge is that I do not have access to my LC filing and my company's lawyer requires approval from my current employer to release the papers to me. Any request for such approval will make my intention clear to my present employer, which would not be good timing at this point.
1) Is there any other way I can get access to my LC filing besides going through my lawyer?
2) Since my LC was filed more than 5 years ago, my current job description, responsibilities, and salary are significantly different that those mentioned in LC. How can my new responsibilities be similar to those filed in the LC given the time differential? Do they need to be similar to what I am doing now?
