Assur is right. The way they treat experience is completely dependent on how your attorney projects and justifies it.

My case is exactly similar to yours. I finished my MS in Industrial Engg in '99 and since then I work as a Unix Admin. This has been my first job and infact, my only job.

The experience that was quoted on my app was 5 years. If they were not to count the exp that I have with my first employer, then, I had none. Work done in your field during your MS, or while doing projects back home in BS, etc could very well justify as your work exp, provided you and your attorney understand it.

Yey, I've finally been certified on May 31, 2003.

I will now start concurrent processing of my I-140 and I-485.

I have updated vjain2k as requested.

I have applied RIR in NJ. The RD is March. 5th, 2002. My position is Application Developer and my job is developing software by using C/C++ in UNIX system.

Did u show the projects u worked on during school or anytother experience?
Where was ur labour filed from , is it from NJ. Is it true that NJ labour are being rejected one in 2 cases?

During/Prior CAN be used. No analysis can be performed for rejection/approval, forget it.

nj guy.. working and living in nj.. want to apply for my labor certification.. any good immigration lawyers out there... my old labor was filed by a maryland lawyer.... ans she really sucked!!! I want someone who can give prompt replies.. and knows what is he doing.. any help would be greatly appreciated...

The NOF was regarding the prevailing wage. In order to rebut this type of NOF, the employer has to agree to increase your salary according to prevailing wage standards once you get your greencard. The employer also has to re-advertise your position for 10 consecutive business days.
 
labor lost in NY

Hello guys I have a very unusual problem looks like my labor is lost in NY DOL

here are the details.

My company has filed for my labor from NJ and around
May 20 (my nj case number is 200108270034 ) we got a reply from NJ labor that my labor has
been forwarded to NY regional but NY regional says that
my case is not available (they cannot locate it) and
they want NJ DOL to resend it but NJ DOL says that NY
DOL has to make a request can anyone suggest me how I
can solve this deadlock your help is really
appreciated thank you.

I got a question regarding re-advertising the position for 10 consecutive business days. Did your employer posted an internal ad or in local new paper or in intranet site? Please let me know.
I think mostly everyone is getting this prevailing wages problem lately.
