After replying to RFE on 4/24/03, my case is forwarded to NY DOL for approval today.

NJ Labor - Civil Engineer

HI All,

I am working in a NJ Civil Co. @ $48k/ yr. since last 2 years.
My job desc in my H-1 is Field/ Staff Engr.
I have a Ph.D in Civil Engr.

My firm is into consulting, hence I could not file in EB-1.
As filing in EB-1 required that my company be into research and it should pay me $64k/yr. So my LC was filed in EB-2 RIR in Dec 2001.

After I joined this company, atleast more than a dozen people have been hired. But most of them work a field engineers and only 2 equivalent to my position. All of these dozen people are US Citizens. I am the only non-Citizen.

Can anybody shed more light regarding any unforeseen problems for labor approval?

Urgent Question

I just found from my employer that NOF was issued at NYDOL due to lower wage than what they say it should be. I have heard that there are 2 ways to approach this:

1) Rebuttal stating current surveys in which I hear it will be referred back to State Labor and then make its way back

2) Salary revision to reflect change but have to put out ads etc once more.

Both points are just what I have heard.

Which would be the quicker way.

Help !!!

Replied : 4/18/2003 (wage change and posting in the office for 10 days)
Transferred to NY DOL: 5/5/2003
Approved: 5/12/2003 (Yet to receive the letter from NY DOL)

How did yo check the status at NJ SESA??? I have a case number from NJ SESA (Not NY DOL), can we check our status by phone/website???

I made my employer call them. They asked the case number, checked and told the status.

Hi All,
I am posting for the first time in the forum. For some reason my old id would not allow me to post any messages. So I had to get a new one..

Anyway, just wanted to let you all know that you all are doing a great job in maintaining the forum. It has provided me a lot of information and has been very helpful in "getting thro" the wait.

Yes, ..I got thro ..finally.. Had applied on June 26th 2001. Got approved on April 23rd 2003..EB3 RIR

Hi Guys,

I checked the NY-DOL Vmail today and it looks like one of the labor's filed by my compnay been approved on MAy'20. I belive it is mine, but I do not know. Waiting for a comfirmation from my HR. I'll keep you posted.

Question: How long does it take for the attorney to get notification from DOL?

Update

My employer talked to the lawyer and he is taking the post ad in office method. So have to wait for that process to get over.
