Hi All,

Here is the situation, I have my wife's H1 filed from a company in Detroit. I had to pay the filing fee of $2320, called the company on April 2 and the contact person said that file is with USCIS. Called them again on April 15th spoke to some other person, who said that my contact is on vacation and they dont have any update and they are tracking the cases by the check numbers.

I just could not get hold of them now, email system is coming back mailer deamon and calls are going to voice mail.

I am hoping that the company is not a scam. What should I do in this scenario?

Is there a way to track the company? I know I can always file a police complaint for the scam.

That was an Indian person that I was working with, been to their office and the guy knew exactly what he was doing and infact answered all the questions that I have. I hope he is not phony.

The $2320 must be paid by the employer by law. By "buying" an H1 you are committing immigration fraud alongside with that employer.

There was a job offer on the table but the company did not want to pay for the H1 filing. The offer included that all the attorney fee will be paid by the employer.

That doesn't matter. The fees are employer's fees. The employer can ask you to pay for the attorney, but not for the fees. H1Bs are for highly skilled individuals who easily make three+ times the fee per month. No serious employer would argue over $2320 with you if they really want to hire you.
