i think you should be ok..are you new h1-b or extension?
i also mail h1 papers on 5th Aug..i didn't heard that cap is reached but it might reach anytime soon...
and for EAC#, it takes 2-3 weeks..so wait and watch

Check it. If you would have sent your papers by US mail and it reached 10th your chances are not very good.
On the Aug 10 the visa quoat is over.
Check you mail return receipt card with your attorney.

What is over on the 10th of Aug? WHat is cap? What is EAC #? I apologize that I don't know a lot here. I am a new applicant to H1B with degrees taken outside US. I understand the regular H1B quota for FY 2005 is met and I may be included in the FY 2006 quota. Pls correct me. My lawyer sent the documents to VSC end of july but up to this time we have not received a filing receipt number yet. We are on premium processing. I have posted in other forum of this site and I got good replies but none has posted if they have similar experience as mine. Is there a way that we could check with USCIS or VSC about my case? FEDEX tracking says my documents were delivered Aug 1. What could be the possible reasons for the delay? Is it possible that filing receipt number does not come but an approval comes out this week? I am still worried, anxious, excited...mixed emotions!!! Please help. Thanks!

EAC no is the receipt no which will be issued by vermont center and the quota was over on Aug 10th itself ie who are all wants to work in US and havent filed H1B before Aug 10th then they have to wait till Oct 2006.
My lawyer says he sent the doc on 2nd Aug and i am not sure when it reached and when it got opened by USCIS.hope i will be in this yrs quota...

Thanks for that clarification, vkm_xy! Are u on premium processing also? I don't have any idea if my documents are opened by VSC already. Hence, no EAC number yet. But I am hoping that they are now reviewing my papers and soon will send approval/disapproval or query. I really do hope that is possible even without the EAC number and still in this year's quota, too. I think we are on the same boat.... Please keep me posted. Good luck to you!

I got the filing receipt number on the 16th of Aug which is actually dated Aug 5. I heard from my lawyer today that it was finally approved on Aug 16. We are just waiting for the documents from VSC now. This would mean I have to get an appointment asap for visa stamping here at the US embassy in my country.

MY APPLICATION REACHED THE VERMONT CENTER ON 9TH AUGUST...(THOUGH IT WAS POSTED ON 8TH AUG BY FEDEX).....
GOT MY RECEIPT NUMBER ON 16TH AUGUST...IN JUST OVER A WEEK.
ASK YOUR COMPANY ABOUT IT....
BUT AS FAR AS I KNOW...YOU HAVE TO GET YOUR RECEIPT IN 7-14 DAYS AFTER YOU FILE YOUR APPLICATION.

Also one important question, is it possible that now i can change my normal processing to premium processing? and how much do we need to pay more?
