new h1 after 1yr at out side usa

Hi,
I will be completing 6 yr by Jan'05, but I have been staying in India since Nov'03. Now I want to file for new H1.

Can I file the new H1 now and enter usa after Nov'04 as I will be completing 1 yr of outside usa or else I need to wait till Jan'05 to file my new h1 and enter usa after jan'06.

You can file for a H1 now with start date Nov 04
