New Employer, Old Pay Stubs H1B status

Hello folks.

Please go over my situation and advise:

1) I have a H1 Visa stamped on my passport from company A that expired on April 15 2004.
2) I changed employers in June 2003 and my H1B got transferred from Company A to consulting Company B.
3) I went to India and came back (Jan end 2004) on the old Visa from company A and showed the immigration officer my new papers from Company B
4)I could'nt find contracts and hence was without work from Feb to now. I have an offer for full time employment from company C. For my H1 transfer, they are requiring pay stubs that are not more than 30 days old. I obviously dont have such recent pay stubs.


So here are my questions:
a) Besides the pay stub issue, is everything else ok in my case?
b) Will INS be ok if I provide them with pay stubs that are a little older
c) If I state that I was on leave without pay for the past couple of months will that be a valid reason for not having most recent pay stubs?

Please advise.

----- as you are not working or getting any payment from B you may be out of Status
b) Will INS be ok if I provide them with pay stubs that are a little older
----- they may not transfer H1 but may approve Fresh NEW h1 with our I-94
c) If I state that I was on leave without pay for the past couple of months will that be a valid reason for not having most recent pay stubs?
------ you must ask this to your lawyer and submit the statement from employer B

Please advise.
