I am an Indian national who is on H1B in the US for the past 3 yrs. I recently got laid off and in the process of getting a new job. The new employer is willing to process my H1B.
The problem is I need to go to my sister's wedding in 45 days. So, I have asked my employer to do premium processing on my transfer application and he has agreed. But I get only a week there in India.
Questions:
1. Do I need to get a new visa pointing to my new employer or would the existing one (which is valid till Aug 2004) be valid for my return? From reading your FAQs, I do but just wanted to confirm.
2. My wife is on a H4 (got when I was with previous employer) and is going to coming back with me. Does she also need to change to a new H4 visa?
3. Can I not do these changes and just come back with the existing visa and change it here?
4. Is everyone asked to do a personal interview these days even for a visa transfer?
5. Would I be subject to the new H1B quota even though this is just a transfer?
Any insights on this would be very helpful.
