Need your help!!!Please!!! I'm on OPT and applying for GC!! Please help!!

1. On form I-130, item 10 "Alien Registration Number" instead of "File Number", should I put the A-number on my OPT EAD card OR should I leave it blank OR should I put "N/A" or "None"? My husband is a USC so I should put "None" under Alien Registration Number, right?

Also,

2. On form G-325A under the “employment in last five years.”, do I have to list the unpaid internships I had? They are on my CPT record.

3. On form G325A for my USC husband "This form is submitted in connection with an application for: 1)naturalization 2)status as permanent resident 3)other (specify)
Should I choose (2) for him also?

4. You suggest that my husband's income is short-lived and I should have a joint sponsor. However, I won't be able to find a joint sponsor. My husband didn't work before July 2011 but he still filed federal income tax for the past 3 years, and obviously they are all zero.

If we show his job offer letter (in medical residency from July 2011 to May 2015) + our joint bank account + zero federal income tax return for 3 years, will it be sufficient enough?

I really don't have a joint sponsor.

No it will not likely be enough. You need to find a joint sponsor. It will save you the wasted time because I am quite certain they will not accept him as a sole sponsor. You might meet an angel interviewer, but I wouldn't count on that.

1. At this stage, anywhere it asks for your A-number or alien registration number, leave it blank. You haven't been given a permanent A-number yet; the temporary one you have on your OPT EAD is not to be used for the green card process. After you get the I-485 receipt or fingerprint notice, it will have your permanent A-number and any subsequent paperwork that asks for your A-number you would provide the new A-number.

For your husband's A-number, if he is a born citizen leave it blank, but if he is a naturalized citizen he'll have an A-number on his naturalization certificate and it would be a good idea (though not mandatory) to write his A-number there so it's easier for them to look up his file.

2. That was training for which you didn't get paid, not employment. I see no reason to list it on the G-325A.

3. Yes, write (2).

4. Unless the both of you combined have enough assets* to eliminate the income requirement, there is a good chance they will tell you to get a joint sponsor. So if you file the paperwork now without a joint sponsor, you'll need to search a joint sponsor within the next 1 or 2 months in case they send you an RFE about the joint sponsor.


*That would be 3 times 125% of the poverty line for a household size of 2 = 3 x $18387 = $55161.

My husband's income fulfills the income requirement for a household of 2. And the reason we have to show our assets is because his income is very short lived. Correct?

"Assets of the principal sponsored immigrant"
a. Can I use my savings account in China?
b. Can I put my apartment in China as my "real estate holdings" (the property is in my name)?

If that's the case, our total asset will be around $250K.
Do I still need a joint-sponsor?

Yes, you can use your savings account in China, provided there isn't a Chinese law that would prevent or extensively delay you from converting it to US currency and transferring the money to the US. For supporting evidence, include several months of bank statements from that account -- at least the past 3 months plus a few more scattered throughout the 6-12 months before that, to show that it's not just some money you borrowed for the short term to boost your appearance of assets.

You can list your apartment, but you will need a certified appraisal of its value, as well as proof of how much you owe on the mortgage or evidence that it is fully paid off. Only the net amount after subtracting the mortgage balance from the resale value counts for the I-864.

If one of the above or both combined (plus you and your husband's US assets) exceed the $55K requirement, you won't need a joint sponsor.

Since my husband filed 3-year federal income tax (zero), do we need to show proof of that? Where can he get the proof? From IRS?

I have several options to prove my assets, please let me know which one is better?

1. Show them my bank acct in China. (My mom opened one for me long long time ago and she saves money into it every year...there should be more than 55K USD in it now)

2. Let my mom wire 55K USD to my bankofamerican saving acct now (I've been using BOA for 4 years...and my mom always wire me tuition + living expenses)

3. Show them an appraisal for my apartment in China (there is no mortgage on the property)...and on the certified appraisal, the value is ard 150K.

2. What is the right address to send the final package if using USPS Priority mail?

3. Should I envelope each application separately, and then put all envelopes in one big envelope?

4. Will my USC spouse fill I-864 too even if I am using my uncle as a sponsor?

5. Can I use my sponsor's IRS recent 3 years transcripts in lieu of Income Tax Returns/W2s/Form 1099s? And must it be the original copy?

If he actually filed the returns, he can get tax return transcripts from the IRS. Visit the local IRS office and they will print the transcripts, or call the IRS to request them, or order them online. See http://www.irs.gov/individuals/article/0,,id=110571,00.html

I would say a combination of 1 and 2 would be best. China has currency control laws that most non-Chinese don't understand, so if you wire the money to your US account (not all of it, but enough to pass the $55161 requirement) it would eliminate the concerns regarding whether you would be able to convert to US currency and transfer the money to the US. But you would still have to show statements from the Chinese bank account so USCIS can see that you also owned the source of the funds (make sure to mention in the cover letter that the Chinese account was the source of the funds of the US account).

#2 is BACKWARDS! PO Box is regular mail. If you want to use a service or have someone sign for it, you need a physical address.
 
The visa number is the red number on your visa. I believe it is in the upper right hand corner. I was puzzled about this one also when we filed and researched it online, and a majority of the website that I have seen said the red number.

Even though the instructions say to submit a copy of the visa if it was issued in the last year, submit a copy anyway. That way if something gets transcribed wrong they have a copy of it in the file. Also send a COPY of your I-94 and copies of any other immigration documents.
