Hi, every one, I need you help. This is my poor situation:

F1 status since I came to U.S. in 2000

4/2001 A company sponsor me apply LC.(EB3; RIR)

3/2002 I got LC and filed I-140

8/2002 I-140 approved and then filed I-485, EAD. My status changed to pending from F1.

10/2002 A company bankrupt. :( :( :(

My question is:

1) How to avoid my I-140 case revoke by bankruptcy. I don't have get EAD yet, so I never work for company A.

2)Can I use AC-21 when I use EAD to find a job.

I really upset right now, please help! Any advice is appreciate.

I-140 validity

1. I-140 doesn't get revoked due to bankruptcy, it can be revoked only based on the sponsoring company's request. So talk to company A to find out if they did send a request to INS or tell them not to revoke it.

2. If #1 is ok, then you can use EAD to find a job and then get ready for 485 RFE sometime in the future.

My company has amended the I-140 with a new one. Once the receipt notice is received, my attny will respond to the 485 RFE with that...hopefully I will get both approved simultaneously...
