Need Urgent Help - I 551 Stamp

Dear Members,

I am a green card holder for past 3 years and my wife applied green card with me (marriage basis) and is still waiting to get her green card.

She had an RFE 3 years back and later her application was put on hold due to retrogression and finally it got transferred to Texas Service Center on march of last year.

Finally she received her I485 approval and went to local uscis office to get her FP done and it has been 3 months now and have not received the GC. Unfortunately USCIS website is not updating her current status and still gives the old status as "Application transferred to Texas Service Center".

My wife got an infopass appointment and explained her situation to immigration office and he gave her a I551 Stamp on her passport valid till July 2008 and said she must be receiving GC in next 10 days and if not to contact USCIS.

My wife contacted USCIS after 10 days (last week) and the uscis rep said that her application is still not approved as the USCIS case status database says.

My wife went again to local immigration office and this time the office himself wrote an email to Texas Service Center to send her gc.

We are travelling to India in 2 weeks ( June 7th ) and we are very much worried whether my wife can enter into US based on I551 stamping alone as she doesnt have AP ( She cannot apply one as her I485 is approved)

Please provide your valuable advice.

Thanks for the reply. I would not be worried much if the case status has been updated to reflect my current status (as I485) approved but it is not.

What are the chances for the immigration officer to look at USCIS case status database and deny entry to USA as my wife doesnt have an AP ?

Any members who have actually undergone this situation, pls provide your valuable suggestion.

Best thing is to apply I-90. With your situation you need not have to pay the fees.

If stamping is valid upto July 2008 better to enter before that. Otherwise go and get another stamping before leaving US.

Does applying for I-90 entitle my wife to enter US without AP ? I am currently more worried about entering US rather than getting the actual physical GC due to the case status database not reflecting that my application is approved.

In other words, even though the case status database doesnt reflect my updated status, can I enter US ONLY with I-551 stamp on my passport ?

----------------YES till the date on Stamp is valid.
Pls clarify.
Your wife case was approved by Local USCIS office and don’t worry about online database. FYI the once the person got GC or Stamp in passport or I-485 gets approved one cant get AP.
I551 Stamp in passport is enough for travel or to enter US before the expiry date of stamp.
FYI filing for I-90 you will not get any receipt from USCIS but they will know that you don’t have got Card. USCIS only send receipt for I-90 if fee is enclosed.
****Your wife should also file Form G-731, - Inquiry About Status of I-551 Alien Registration Card
