Need Some Advice Please!!!!!

I came to the U.S. ten years ago of which I was out of status for nine years. The DHS arrested me in my house in New York in November 2005 and I had the option of voluntary departure or appear before an immigration judge. On my first hearing, in FEB 2006, the judge read out the charges and the options I had. I told the judge that I would like to apply for political asylum. The judge gave my next hearing date of June 2006 where I am supposed submit all the paperwork. The judge did not mention about the one year deadline and mentioned to me he would not approach the case from a technical point of view and would give me a fair trial. I did so in June 2006 and my next court date in NOV 2006. What can I expect in NOV 2006 hearing? Also, I would like to apply for work authorization and I have to wait 150 days which will be NOV 10 and my court hearing is on NOV 16 but the only paperwork that I have to prove my asylum case is the biometric appointment which has a date of July. How can I prove the 150 days?

Well you should be prepared to answer certain questions like: Why you have waited 9 years and never applied for asylum before?
 
You should have received something from the immigration court proving the filing of your asylum application. If not you should contact the clerk for some written proof. Does your Biometric appointment letter mention I-589 by any chance?

I also advise you have to hire an attorney help your asylum application. Remember that people with representation have a better chance of succeeding. The DHS will have an attorney there to oppose you.
 
To find out if 150 days have passed you will need to call the following number
1-800-898-7180.

1. Enter your Alien Number
2. Then press option 2 for case processing

At option 2 the system will let you know how many days have passed, if 150 days have passed you can go ahead and file for the EAD.

If the system says that the clock is stopped and 150 days have passed you can still apply for the EAD.

Finally if the system says that the clock is stopped and 0 days have passed you cannot apply for the EAD and you or your lawyer can't do anything you will have to wait until you get your final decision.

My advise would be to focus on your upcoming hearing in Nov 2006 because if you do apply for EAD you won't get it until Nov or Dec.
