Hey guys. My fiance and I have been together for 2 years. She's a russian girl that came to the US as a student and stayed so while she was here legally initially she is now illegal. We are planning to get married in the next month and are wondering how we should poceed to try and make her legal. I am a citizen. Any info would be appreciated.

Groon, I'll point you in the right direction.
You want to fill out a I-485, I-130 and a I-765.
Go here http://uscis.gov/graphics/formsfee/index.htm and download these forms. Prepare them, they can be scarey, but after seperating the instruction from the actual part you fill out, its easy.

Does she have her I-94? She needs it. She also needs her Birth Certificate translated into english and Notorized. You also need your Birth Certificate. Get all of her info ready, her parents names where they were born, and the same with you.

Your gonna need 3 years of Tax returns, easy way I did this was call local IRS dept. and have them send me Tax Transcripts for past 3 years, I got them in 2 days.

Don't worry about her being Illegal, I have a little Illagal wifey myself. The only thing is she cannot leave the country till she gets her passport stamped. If she leaves the country, she will not be allowed back in for 10 years. Do Not waste money on the Advance Parole Travel Doc. It will be denied.

These are some basics. Don't wait around till after your married to get started, you want these all filled out so you can mail them out immediately. Where you located? That will determine where you send the stuff.

I'm in northern Indiana.

It doesnt matter where you are located inside the US. All family based GC applications should be sent to the Chicago lock box.

was your Russian fiance on J-1 visa? Is she subject to Home Residency requirement? If she is, she cannot adjust her status to permanent resident until she spends two years at home.

Just some more info into the topic.

In case the person is not a J! you will be allowed to apply for advance parole and the probable will give you one, BUTTTTTTTTTTTTTTTTTTTTTT, When you try to come back(with the Advance parole) the 10 year ban will overlap the Advance parole and your wife will be send back to russia Crazy UHHH

Well, like the last post said "DO NOT LEAVE THE COUNTRY" until you get your passport stamp

Good luck

Just found out she's not bound by the 2 year residency req. So all good there. As for my past tax returns, I do my taxes via Turbo tax on the web. They keep copies of my past returns. I just downloaded my last 3 returns. Will they accept these print outs?

I am in the same boat as you. What kind of things should I prepare for the interview?
Thanks.
