Hi Ginnu & all,
I need your opinion on this matter:
My 2nd term H-1B visa will expire in Jan. 2004. However, my 6 years limit time is in October, 2004. My LC is in process by my current employer (passed 365 days already), not yet approved. If I want to change employer, that is willing to sponsor me, what will be the good move? Can I transfer my H-1B visa (with premium processing) to the new employer. And, hopefully before October, 2004 my LC will be cleared already. If that's the case can I then apply concurrently I-140/I-485/EAD (using the LC from my previous employer), through my new employer? If the LC is not cleared until Aug/Sep 2004, can I apply for H-1B 7th year extension through my new employer, but using the LC receipt from my previous employer?
Is there any other way?

You cannot transfer the GC process from one employer to another at LC stage.
If the LC is not cleared until sept 2004, you can apply for 7th year extension with your sponsoring employer's cooperation only. Only at 485 stage, you become free of the employer. till then, if you want the GC process to continue, you need to bear with the abuse.

If LC is cleared, with cooperation of prev employer, can I submit I-140 with the new employer (along with I-485)?
Also, can I transfer & extend my H-1B concurrently (the 3rd time, until October 2004), using premium processing?
