i came in to us 2004 .my husband is still in my home country.i already filed for him and i received an appoval notice 2005. no visa number has been allocated to him yet. can anyone enlighten me abt this process:confused: :confused: :confused:
 
I assume you are a GC holder. Your husband will get his GC when a visa number is available. How far are you from becoming a US citizen?
 
You can give that a try, but again, being the spouse of a PR holder, it will be difficult for him to obtain an F-1 visa since he needs to overcome 214(b). Being Nigerian adds to the problem. Since it is one of the countries with a high rate of visa fraud, the consul will assume that the F-1 is being applied for just to circumvent the PR waiting period. I know this sounds harsh, but that is the way it is.

i think you should be patient and allow your petition to go through the normal process, because if for whatever reason he is denied the f1 visa, that might jeopardize his coming over as per time wise, it might take longer for you to get him over. advance fee fraud has nothing to do with your case, goodluck.

It won't if he merely gets denied for immigrant intent.

I'd still like to find out if he is eligible for FTJ, or needs to go via FB2.
 
if you are gonna become a usc soon, that will speed things up, because the spouses of usc have visa numbers readily available to them.

Ah; and since that fiscal year is over, he cannot get derivative benefits. So FB2 it is.

Since he's FB2A, he won't have a visa number allocated for another 2.5 years or so; you may or may not be a US citizen by then. If you are, I'd send NVC a copy of your naturalization certificate and request that they re-categorize your petition as an Immediate Relative (for which no visa number is required), if not then when his priority date is about six-nine months away from being current NVC will get in touch.

Before then, his only hope is an H-1 or L-1, which requires US employer sponsorship.
