Need Help whether I can use AP to enter USA when H1B is under 221g pending

Dear Friends,

I came to India after applying for I-140 and I-485. I arrived here on Sep 12th.

My application received by the USCIS for I-140 and I-485 on Sep 14th.
I-140 appoved on Dec 12th
AP approved on Sep 29th

I applied for H1b and kept under pending under 221g.

My question is Can I use my AP to enter US even though I exited out of USA on Sep 12th and AP got approved on Sep 29th. My H1b application is pending at chennai Consulate applied on Oct 12th. I have been waiting for 3 months and so far no response. My passport is also with the consulate.

Please advise.
 
Why did you leave before AP approval ?
I131 document clearly mentioned that
If you travel before advance parole document is issued, your application will be deemed abandoned if
1 you depart from the US, or
2. The person seeking advance parole atempts to enter the United States before the decision was made on the application.

Using H1 is safer option in this case.
 
Due to emergency, I have to leave usa at that period. Can I apply again if I come thru H1?

Please let me know
 
reason for 221(g)

Hi advicegc,
May I know why you were given 221(g)?
I have a similar situation and would like to get an idea on how long it takes for them to clear 221(g).

My wife went for H4 and I did not have valid stamping on mine and used my AP on my last trip. My GC is still pending. The VO asked her about the GC and gave her 221g and marked it for adminstrative reason.

There was no reason given for 221g. They just mentioned admin processing. It has been 3 months and still they are saying is waiting for clearance from DOS Washington. If you have any inputs, please let me know
 
221(g) at Mumbai...Have AP

Hi,
Please help. I was here to get married and now i am left toally clueless.

This is my second H1B renewal in Mumbai. Last year everything was smooth. But this time i got 221(g) yellow sheet. (My employer is still the same).
Questions:
1)How long does it take approximately to get the Admin Processing done? (Visa officer told me it should be less than a week)
2)I also have Advance Parole. Can i use Advance Parole and go back to the US or do i have to wait until i hear something from the consulate?

I hope things will be positive pretty soon.

Return to US on AP?

I need your help. My wife and I are in India on vacation.

My wife went to US consulate, Mumbai for H1B visa stamping. However, her passport was returned along with a white document to fill out for verification of technical qualification and asked to email the requested forms to an email address for verification. (Please note: This is different from I797 verfication that started a month or so back) She was told that it might take 2 weeks or so to verify the technical qualification which will stretch her vacation beyond her original return date.

Q1) Can she return on a valid advanced parole document? Will she have issues during secondary inspection in US based on her experience at US consulate in Mumbai?

Q2) Does anyone have info on what technical qualification is all about?
