Need Help Very URGENT: 7th year on H1B

Hi I am in troble now, Here is my situation:
I am on 7year extension expiring on Dec 2005, LC was filed in 2001 from Dallas region and stuck in backlock reduction center, and here is the worst part, I got layed off last week.

Now I am looking for expert help from gurus about what to do next?

Can I approach to any employer to get extension? or go back to India and come back with new H1.

Your help is very appriciate.

You need to act quickly. Get another job offer from a different employer and you can transfer the remaining 6 months of H1 7th year to that new employer. Then you can extend your H1 for 8th year with that new employer based on your already filed LC. You will need a proof of filing that LC, this can be a letter or receipt from DOL and it should show the date when that LC was filed.

You cannot use this same LC with your new employer, so that new employer will have to file a new LC for you in order for you to get your GC.

Who filed your LC, the company laid off you? If ans is yes, it is very difficult to extend the 8th year, if the laid off company withdraw their petition. Did they laid off you alone any more people. It is very important to get LC approved. LC will not get approved, if the same company laid off people earlier,

If that is the case, go back India work for a year, and come with new visa. Next 6 years you are OK.

Yes I am in proces to talking to another employer and working on get things done, I am not sure about the PERM processing about GC, whether that will be applicatble in my case.

There is un official layoff going on, they have not declared it, will that be a program again.

If there is a lay off , DOL come to know first, they only process all PERM.
 
I checked with the company, they said it is not layoff, this termination is due to the loss of project. I am not sure whether this is ok.

Assist me.
