the I-94 says no eos no cos and aos, is marriage still ok? girlfriend visiting back but had that stamped on her I-94. And now she wants to get married with me (Im a citizen ) . Is it effective when we file form I-485 / or file form I-765 apply for green card and when we go to interview with the officer ?thank you...appreciate

thanks a lot , but i still dont understand : if she apply for adjustment of status- (form i-485 and i-765) ,is any restricted of the form on her i-94 with 3 no (no eos/cos/aos ?) and what is a cp route ?thanks ....
 
When POE inspectors do not fully believe an entry applicant's stated intentions, they often annotate the I-94 with "No COS/EOS/AOS". The litmus test is to see if the applicant will leave in a timely fashion as stated at the POE. Now if such an applicant applies for AOS and the application comes up for adjudication, there is a possibility that the AOS adjudicator will investigate what happened at the POE. There is also a chance that the applicant may be accused of fraud/misrepresentation. That can get ugly. Thus if such an applicant wants a green card, best option is for the sponsor to file an I-130 and the B-2 visitor returns to his/her country to attend a green card interview at the local US consulate. This is called CP, consular processing.

thanks for your advice but i ask my lawyer , if she returns to her country , their will be bar for 10 years not to enter to u.s even since she violate her visa with 3 "NO"...I believe that she can fills out form i-601 for waiver indamissibility isn't it or is any another way to solve this problem ...?thanks...
 
nah , she just had an 3 no stamps on her passport which is (no e.o.s /no a.o.s /no c.o.s) and overstay , now she wants to file form i-130 and i-485 with me ,she never been banned or deportion or anything...
 
When did she enter the US and what date is written on the I-94?
