Hey Guys,
My wife was working for Comnay A in 2004, we went to India in Nov 2004 when she got her H1B stamped in Delhi. The H1B on her passport has Company A's name on it.
In April 2005 she switched jobs and had her H1B transferred to Company B. She now has an aproved I-797 with Company B as the petitioner.

Questions:
1. Does she have to get her H1B stamped on the passport to leave and enter US again?
2. If yes for Q#1, then can she have her new H1B stamped in US?
3. If no for Q#2, then does the stamping have to be in India or can she go to Canada/Mexico and get her H1B stamped?

Any help is appreciated.

Thanks in advance.

Not necessary. (no details from you reg validity of old visa) How long old H1 with sponser A visa is valid in pp.

2. If yes for Q#1, then can she have her new H1B stamped in US?

In US no one can validate their visa , it all gone.
3. If no for Q#2, then does the stamping have to be in India or can she go to Canada/Mexico and get her H1B stamped? stampimg to be done outside US, location is yur choice
Any help is appreciated.

Thanks in advance.

Thanks for your reply.
Her visa on the passport with Company A is valid until Jan 2008.

So, according to you, she does not have to have the VISA stamped again until Jan 2008 even if she is not working for Company A now and still can leave & enter US without any immigration issues.

Please confirm.

Yes -- she can re-enter the US on the old visa till that visa is valid.
All she needs to have is proof of current H status -- letters and paystubs from the new company, approved 797 and copy of approved LCA.

There is no problem with traveling on old company's visa -- many of us have done that / still do that.
