First of all I would like to thank everyone for their input in my case.
Here is some questions I have for my N400.
I'm eligible through marriage to a US citizen if that helps, I came here legally on a tourist visa, after my visa expired I stayed here illegally for about 2 years. I got married in 2006.


Part 10. Q5
Do you owe any federal or states taxes that are overdue?
I'm on a payment plan to pay off what I owed on my 2010 taxes(1300$). Making my payments on time every month.

Part 10. Q13
Have you ever called yourself a "nonresident" on federal or state tax?

I got married in 2006 but didn't receive my SSN till sometime in 2007 and I didn't work in 2006 tax season. We filed joined married and put 000 00 0000 for my SSN.
Is that what counts as nonresident?

Have you ever failed to file federal or state tax return because you considered yourself to be a "nonresident"?

I didn't file my first 3 years here. I also did not produce an income during that time.

Any help or pointers are welcome. I'm ready to submit my file and cant wait to get this over with.

I am not entirely sure about this one but I think the safest thing for you to do is answer "Yes" to this question and attach a written explanation about the payment plan. I would also attach copies of whatever documentation you have from IRS regarding this payment plan.

No, it most certainly does not. You should answer "NO" to this question. Claiming to be a non-resident means having filed IRS form 1040NR or 1040NR-EZ (Non-resident alien tax return).

Answer "NO" to this question. You were not require to file a tax return for those years, so you did not fail to file.
 
just did a double check and i think i found something i wasnt aware of.

the documents listed on the uscis website (taxes,marriege certs etc) I have to submit that with application or bring with me to interview?
And no originals right? just copies?

Send copies of the supporting documents with the N-400 application and bring the originals to the interview.
 
how about tax papers, should I make copies of the entire return or just the first page?
im starting to freak out about this a little...

Neither. Get official transcripts of your tax returns from IRS - that is what the IO will need to see, not the actual copies of the returns you filed. You can requests the transcripts by phone from IRS; if you don't have time and the interview is coming up soon, go to the local IRS office in person and they'll give you the transcripts right then and there.
 
ok, just googled irs and there is one not too far so i will get them myself.
I had a annuled marriage, doo i need a certified copy of that or just a normal copy?

Isn't the annulled marriage info already in your immigration file? I hope it was not the marriage through which you got a greencard? :p
